Overview of the Act

Australia has one of the highest rates of pet ownership in the world. For the vast majority of us our dogs and cats are our friends and companions. They are much loved members of our families. However, there are a small number of people who do not care for their animals responsibly. These animals often become a problem for the community.

The new Companion Animals Act, which first came into effect in September 1998, is designed to benefit pets, their owners and the wider community.

The permanent identification and lifetime registration system which came into effect on 1 July 1999 greatly assists authorities in returning lost and injured animals to their owners. It provides NSW councils with a more effective means of keeping track of dogs and cats for the benefit of the wider community.

The Companion Animals Act, 1998 requires dog owners to have:
 
a    Pups must be microchipped by 12 weeks of age or earlier if sold or given away.
 
a   All dogs over six months of age must be microchipped and lifetime registered.
 
a   In addition to being microchipped and lifetime registered when away from your property, your dog must wear a collar and ID tag.
 
a   When away from your property your dog is to be under effective control.  This means it must be on a lead unless you are in a specified off-leash area.  One person may not walk more than four dogs.
 
a    Always pick up your dog's droppings (faeces) in any public place.
 
a    Dogs must not be encouraed to attack.  A person who sets on or urges a dog to attack, bite, harass or chase any person or animal (other than vermin) is guilty of an offence, whether or not actual injury is caused.
 
Dog Owners are encouraged to:
 
R   Ensure your dog is trained and well socialised and not aggressive to people or other animals.
 
R   Desex their dog.
 
Ensure their dog does not bark excessively
 
R   Ensure you have adequate fencing to contain your dog on your property, especially in rural areas.
 
ALL DOGS THAT ARE IMPOUNDED MUST BE MICROCHIPPED AND LIFETIME REGISTERED BEFORE BEING RELEASED.

The Companion Animals Act, 1998 requires cat owners to have:
 
*    Kittens must be microchipped by 12 weeks of age or earlier if sold or given away
 
*    All cats over 6 months of age must be microchipped and lifetime registered
 
*    If you owned your cat before 1 July, 1999, you do not have to register your cat.  However, it must have either a collar and ID tag or be microchipped.
 
*    ALL cats must be microchipped and lifetime registered if sold or given away (even if you owned the cat before 1 July 1999)
 
ALL CATS IMPOUNDED MUST BE MICROCHIPPED AND LIFETIME REGISTERED BEFORE BEING RELEASED.

How to Life Time Register your Companion Animal in New South Wales
 
Registering your Dog or Cat is a two step process:
 
Step 1:  You need to have your pet microchipped
 
Step 2:  Go to your local Council Chambers (in NSW) with your microchip paperwork to register your animal.
 
Registration Fees under the NSW Companion Animals Act.

Entire Dog or Cat (undesexed)

 $150

 

Entire Dog or Cat owned by a registered breeder

$40

Proof of your affiliation of a relevant breeders authority will be required for the discounted registration rate.

Desexed Dog or Cat

$40

 Proof of desexing (available from your vet) will be required for the discounted registration rate.

Desexed Dog or Cat owned by Pensioner

$15

Proof of desexing (available from your vet) and current Pensioners Card will be required for the discounted registration rate. 

 
CHANGE OF OWNERSHIP/DETAILS ( this includes changes of ownership, changes in your address, a change of phone numbers, or a change of secondary contact details)
 
NB: There is no charge or fee for changing details, if details are not correct, in the event your animal is impounded you will not be readily able to be contacted to reclaim your animal.  Impounding fees apply to impounded animals.
 
Section 11 of the companion Animals Act 1998 requires owners to inform the Register (go to any Council within NSW) of any change in their animals registration or permanent identification (microchip) information within 14 days.
 
In the case of change of ownership (by sale or give away), this section applies to the seller, or "old" owner of the animal to notify council.
 
It is recommended that a "change of Ownership" form be signed at the point of sale or transfer, enabling both parties to sign it.  Change of Ownership forms are available from any Council office, or http://www.dlg.nsw.gov.au/dlg/dlghome/dlg_InformationIndex.asp?areaindex=CA&index=301 to print out relevant forms.
